1. Acceptance of these Terms
These Website Terms of Use ("Terms") govern your access to and use of www.revpilates.com.au and any related subdomains, member portal or booking interface accessible through it (together, the "Website").
By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website.
These Terms apply in addition to, not instead of:

REV's Privacy Policy;

REV's Photography and Media Consent Policy;
-
any membership agreement, waiver, or intake/health declaration you complete separately; and
-
any specific terms presented to you at the point of booking or purchase.
Where there is a direct inconsistency between these Terms and a document listed above on a matter that document specifically governs (for example, a waiver governing assumption of risk, or a membership agreement governing cancellation), that more specific document prevails on that matter.
2. Changes to these Terms
REV may update these Terms from time to time to reflect changes to the Website, our services, applicable law, or our business practices. The updated Terms will be posted on the Website with a revised effective date. Your continued use of the Website after an update takes effect constitutes acceptance of the updated Terms. Where a change is material, REV may also notify members directly, consistent with the notification approach described in REV's Privacy Policy.
3. Eligibility and accounts
3.1 Eligibility
You must be at least 18 years old to create a REV account or enter into a membership in your own right. A person under 18 may participate in REV services where a parent or legal guardian has completed the relevant intake, waiver and consent documentation on their behalf, consistent with REV's Privacy Policy (Section 3.10).
3.2 Account registration
Where the Website requires you to create an account (for example, to book classes or manage a membership), you agree to:

provide accurate, current and complete information;

keep your login credentials confidential;

notify REV promptly of any unauthorised use of your account; and
-
accept responsibility for activity that occurs under your account, except to the extent caused by REV's fault.
REV may suspend or close an account where we reasonably believe it has been used in breach of these Terms, for fraudulent purposes, or to protect the security of the Website or other users.
4. Use of the Website
You agree to use the Website only for lawful purposes and in a manner consistent with these Terms. You must not:

use the Website in a way that damages, disables, overburdens or impairs it, or interferes with any other person's use;

attempt to gain unauthorised access to any part of the Website, other user accounts, or REV's systems;

introduce viruses, malware, or other harmful code;

scrape, harvest or extract data from the Website using automated means without REV's prior written consent;

use the Website to transmit unsolicited advertising or spam; or
-
impersonate any person or misrepresent your affiliation with any person or entity.
REV may restrict, suspend or terminate your access to the Website, in whole or in part, if we reasonably believe you have breached these Terms.
5. Bookings, memberships and payments
5.1 How bookings work
The Website allows you to view class timetables, book classes, purchase memberships or class passes, and manage your bookings, subject to availability and REV's current booking and cancellation policies.
5.2 Payment processing
Payments made through the Website are processed by Stripe. By making a payment, you also agree to Stripe's applicable terms. REV does not itself store your complete card details; this is handled directly by Stripe, as described in REV's Privacy Policy (Section 3.3).
5.3 Pricing and availability
REV takes reasonable care to ensure pricing and class availability displayed on the Website are accurate, but errors may occur. Where a pricing or availability error occurs, REV will contact you before processing your booking or payment, and you may choose to proceed at the correct price, or cancel without charge.
5.4 Cancellations, refunds and membership terms
Specific cancellation windows, no-show policies, membership hold/suspension terms, and refund conditions are set out separately in REV's membership terms and conditions provided at sign-up (or, where applicable, displayed at the point of booking), and are not restated in full here. Nothing in these Terms limits any right you have under the Australian Consumer Law (see Section 9).
6. Intellectual property
All content on the Website — including text, graphics, logos, class descriptions, images, video, and the overall look and feel — is owned by or licensed to REV and is protected by Australian and international intellectual property laws, unless otherwise indicated.
You may view, download and print material from the Website for your own personal, non-commercial use. You must not reproduce, distribute, modify, publicly display, or create derivative works from any part of the Website for commercial purposes without REV's prior written consent.
"REV Pilates" and associated logos are trade marks of REV (registered or unregistered). Nothing in these Terms grants you a licence to use REV's trade marks without separate written permission.
7. User-generated content
If the Website allows you to submit content — such as a testimonial, review, comment or photo — you:

confirm you own or have the right to submit that content;
-
grant REV a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with operating and promoting REV, consistent with any specific media consent obtained under REV's Photography and Media Consent Policy where the content includes your image; and
-
remain responsible for ensuring the content does not infringe any third party's rights or applicable law.
REV may, but is not obliged to, monitor or remove user-generated content at its discretion, including content REV reasonably considers offensive, inaccurate, or in breach of these Terms.
8. Health, safety and assumption of risk
Pilates and other exercise services offered by REV involve inherent risks. Nothing on the Website constitutes medical advice, and the Website is not a substitute for professional medical guidance specific to your circumstances.
Before participating in any class, you are required to complete REV's separate intake form, pre-exercise screening and waiver, which set out the specific risks, your health disclosure obligations, and the terms on which you assume those risks. Those documents — not these Terms — govern assumption of risk and any limitation of REV's liability in relation to physical participation in classes.
9. Limitation of liability
To the maximum extent permitted by law:

the Website and its content are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied;

REV does not warrant that the Website will be uninterrupted, error-free, or free of viruses or harmful components; and
-
REV excludes all liability for any indirect, consequential, or special loss arising from your use of, or inability to use, the Website.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where REV's liability for breach of a non-excludable guarantee can be limited, REV's liability is limited, at REV's option, to resupplying the relevant service or paying the cost of having the service resupplied.
10. Indemnity
To the extent permitted by law, you agree to indemnify REV against any loss, damage, cost or expense (including reasonable legal costs) arising from your breach of these Terms or your misuse of the Website, except to the extent caused by REV's own negligence or wrongful act.
11. Third-party links and services
The Website may contain links to third-party websites or integrate third-party services (for example, Wix, Stripe, Google, Meta, or social media platforms), as described in REV's Privacy Policy. REV does not control and is not responsible for the content, accuracy, or privacy practices of third-party websites or services. Your use of a third-party website or service is subject to that third party's own terms and policies.
12. Privacy
REV's collection, use, and disclosure of personal information through the Website is governed by REV's Privacy Policy, which forms part of these Terms by reference.
13. Termination and suspension
REV may suspend or discontinue the Website, or any part of it, at any time without liability to you, except where required by law. REV may also suspend or terminate your access to the Website in accordance with Sections 3.2 and 4.
Termination of your Website access does not, by itself, terminate a separate membership or booking arrangement, which is governed by its own terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You and REV each submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from those courts.
